Tucson Escooters & Ebikes – Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the services provided by Tucson Escooters & Ebikes ("we," "us," or "our"), including our website, in-store services, and any related communications. By using our services, you agree to be bound by these Terms.
1. Services Provided
We provide electric scooter and e-bike diagnostics, repair, and related services. We will diagnose the problem with your device and provide you with an estimate for the repair. We will only perform the repair if you approve the estimate.
2. Estimates and Payment
Estimates are provided based on our initial assessment of the device. The actual cost of the repair may vary if additional issues are discovered during the repair process. We will notify you of any changes to the estimate and obtain your approval before proceeding. Approval may be provided in writing, via SMS, email, or verbally.
Payment is due upon completion of the repair prior to release of the device.
A diagnostic fee may be charged if you decline the repair after we have diagnosed the problem. This fee covers the time and expertise involved in diagnosing the issue.
3. Data Loss / Electronic Systems
Important: You are solely responsible for backing up any data or app-connected settings before bringing your device in for repair. We are not responsible for any data loss that may occur during the repair process.
While we take precautions, we cannot guarantee that data, firmware settings, or app connectivity will not be affected during repair.
4. Warranty
We offer limited warranty coverage based on the specific repair service performed. Warranty covers defects in workmanship for the applicable warranty period.
The warranty does not cover:

Accidental damage

Misuse or neglect

Liquid damage

Unauthorized modifications or third-party repairs
The warranty is void if the device is opened or tampered with by anyone other than us.
To claim warranty service, you must return the device with proof of service.
5. Limitation of Liability
To the fullest extent permitted by applicable law, our liability for any damages arising out of or relating to our services is limited to the amount you paid for the repair.
We are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, loss of income, or additional repair costs.
Some states do not allow the exclusion or limitation of certain damages, so the above limitation may not apply to you.
6. Abandoned Devices
Customers are expected to pick up completed devices within a reasonable timeframe after notification.
Devices not picked up within 2 days of completion may incur a storage fee of $10 per day.
If you fail to pick up your device within 30 days after notification, we may consider the device abandoned. We will make reasonable attempts to contact you via phone, SMS, and/or email before taking further action.
We reserve the right to sell or dispose of abandoned devices to recover unpaid balances, storage fees, and repair costs, in accordance with applicable laws.
7. SMS/Text Messaging
We use SMS/text messaging through our point-of-sale (POS) system to communicate with you regarding appointment reminders, repair updates, and, with your express consent, occasional promotional offers relevant to your device or repair history.
Consent: By providing your mobile phone number and opting in to receive SMS messages from us, you consent to receive text messages from Tucson Escooters & Ebikes for the purposes outlined above. Consent may be provided verbally, digitally, or in writing.
Opt-Out: You can opt out at any time by replying "STOP" to any message.
Message Frequency: Message frequency varies and is primarily related to repair updates and service communication.
Message and Data Rates: Message and data rates may apply. Check with your carrier for details.
10DLC Compliance: We comply with all applicable A2P/10DLC messaging regulations.

No Sharing of Information: We do not sell or share your mobile number with third parties for marketing purposes.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona.
9. Dispute Resolution
Any dispute arising out of or relating to these Terms shall be handled in accordance with applicable laws within the State of Arizona.
10. Entire Agreement
These Terms constitute the entire agreement between you and us relating to our services and supersede all prior or contemporaneous communications.
11. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12. Changes to These Terms
We may update these Terms from time to time. Updates will be posted on our website with a revised "Last Updated Date." Continued use of our services constitutes acceptance of those changes.
